РУМЪНИЯ

(Спогодба за сътрудничество в областта на здравеопазването и медицинската наука между правителството на Република България и правителството на Румъния - подписана на 28 февруари 1996 г., в сила от 3 юли 1996 г.)

При нещастни случаи, заразни заболявания и в случаи на внезапно възникнали заболявания, застрашаващи живота, страните осигуряват безплатно на всички граждани от другата страна, временно пребиваващи на тяхната територия, необходимата медицинска помощ в държавни здравни заведения в обем, достатъчен за завръщането на болния в родината му без опасност от влошаване на здравословното му състояние. Когато състоянието на болния позволява транспортирането му, страната домакин ще осигури, ако е необходимо, безплатно транспортиране до границата на другата страна, откъдето той ще бъде поет от националните служби.

Двете страни осигуряват на реципрочна основа безплатна медицинска помощ в държавните здравни заведения на Румъния и Република България по списъци, периодично актуализирани от страните, на: дипломатическия персонал и другите служители при посолствата на страните, служителите при постоянните представителства, постоянните кореспонденти по печата и тези на националните информационни институции на двете страни, както и членовете на техните семейства и лицата, които ги обслужват, румънските и българските представители, които са на работа по двустранни спогодби, както и представителите на официалните румънска и българска православна църква.

ORDINANCE NO. 2 OF 1ST OF JULY 2005 ON THE TERMS AND ORDER OF PROVIDING MEDICAL AID TO THE FOREIGNERS, WHO DO NOT ENJOY THE RIGHTS OF THE BULGARIAN CITIZENS

ISSUED BY THE MINISTRY OF HEALTH, BY THE MINISTRY OF FOREIGN AFFAIRS AND BY THE MINISTRY OF JUSTICE

Chapter one.

GENERAL PROVISIONS

Art. 1. By this ordinance the term and order of providing and payment of the medical aid to the foreigners in the cases where they do not enjoy the right of available medical aid as Bulgarian citizens shall be settled.

Art. 2. Under the order of this ordinance medical aid to foreigners, sent for treatment under health agreements where the Republic of Bulgaria is a party of such agreements, shall be provided.

Art. 3. (1) The ordinance shall be applied for the foreigners who stay in the country for a long-term or who pass through the country.

(2) This ordinance shall be applied also in the cases, where the persons under Para 1 have obtained prolongation of the term for short-term stay.

(3) The ordinance shall be applied also to the persons under Art. 24, Para 1, items 5, 7, 8, 9, 10, 13, 14 and 16 of the Law on the Foreigners on the Republic of Bulgaria. The legal ground for the stay of the persons under Art. 24, Para 1 of the Law on the Foreigners in the Republic of Bulgaria shall be certified by the services of administrative control of foreigners by an autographic cover in writing in the national passport of the foreigner above the reflected by a stamp permit for a prolonged stay.

Art. 4. (1) The ordinance shall not be applied for foreigners who have no citizenship, but have obtained permitted long-term stay in the Republic of Bulgaria, except those under Art. 3, Para 3 who have right of available medical aid as the Bulgarian citizens have.

(2) The ordinance shall not be applied for persons who have provided status of refugees or right of sanctuary, from the date of initiation of the procedures for providing status of refugee or right of sanctuary.

Art. 5. (1) The foreigners who stay for a short-term in the Republic of Bulgaria, as well as persons with double and foreign citizenship who do not insure themselves under the order of the Law on the Health Insurance, shall pay the value of the provided medical aid, except otherwise provided in an international treaty, where the Republic of Bulgaria is a party of.

(2) The medical aid provided to the persons under Para 1 by medical institutions, shall be paid per prices as determined by the respective medical institutions.

Art. 6. (1) Giving medical aid under Art. 45 of the Law on the Health Insurance to the foreigners under Art. 3. Para 3 who are health-insured, shall be paid by the National Health Insurance Fund.

(2) Out of the range of the obligatory health insurance, the persons under Para 1 shall pay the given medical aid per prices, as determined by the respective medical institutions.

Art. 7. The persons under Art. 3 shall pay the value of the provided medical services which are related with:

1.providng blood and blood-products;

2. transplantation of organs, tissues and cells;

3. performance of immunizations and re-immunizations.

Art. 8. The additionally required services out of the given medical aid, as well as the expenses for a stay in the medical institution of the admitted companions of foreigners shall be paid per prices as determined by the respective medical institutions.

Art. 9. The medical aid for foreigners from countries, with which the Republic of Bulgaria has concluded agreements or treaties in the field of health and social policy, shall be given under the order of these agreements as per the Appendix.

Art. 10. The foreigners who stay for a short-term in the country or pass through it, when entering in the Republic of Bulgaria or passing through it, shall have medical insurance or health insurance.

Art. 11. (1) The treatment of the members of the diplomatic, of the consular and of the other permanent representative offices of the foreign countries here and the accredited to the Ministry of Foreign Affairs of the Republic of Bulgaria permanent representatives and experts of international organizations, of their assistants and technical-support staff and members of their families shall be performed as per the concluded agreements and treaties. 

(2) In the cases where no agreements and treaties are concluded, the persons under Para 1 shall pay the cost of the given medical aid per prices as determined by the medical institution.

ROMANIA

(Agreement on co-operation in the field of health protection and the of the medical science between the government of the Republic of Bulgaria and the government of the Romania – signed on the 28th of February 1996, in force from the 3rd of July 1996.)

In cases of accidents, contagous diseases and in cases of suddenly occurred diseases endangering the life, the countries shall provide to all citizens of the other country who stay temporary on its territory, the necessary medical aid at state medical institutions and in a range sufficient for the return of the ill person to his/her mother country without danger of exacerbation of his health status. If the status of the ill allows his/her transportation, the hosting country shall provide, if necessary, a free of charge transportation to the boundary of the other country, where he/she shall be taken by the national services.

The two countries shall provide on the reciprocity base medical aid, at the state medical institutions of Romania and of the Republic of Bulgaria per lists which shall be periodically updated by the countries, to : the diplomatic staff to the embassies of the countries, the officers at the permanent representative – offices, the permanent press- correspondents and those of the national mass- media of the two countries, as well as to the members of their families and to the serving them persons, to the Romanian and to the Bulgarian representatives who work under bilateral agreements, as well as to the representatives of the official Romanian and of the Bulgarian Orthodox Church.
