L A W ON INTERNAL AFFAIRS

(The Law on Internal Affairs was proclaimed on the session held on 29th March 1995 by the Assembly of the Republic of Macedonia.)

I GENERAL PROVISIONS

Article 1

For the purpose of this law, internal affairs shall refer to:

- protection of life, personal security and protection of citizen's property;

- crime prevention, detection and seizure of perpetrators and their handing over to competent bodies;

- protection of human rights and freedoms of citizens guaranteed by the Constitution;

- prevention of forceful destruction of democratic institutions established by the Constitution of the Republic of Macedonia;

- maintenance of public order and peace;

- prevention of exciting national, racial and religious hatred and intolerance;

- securing specific persons and buildings;

- regulating and controlling traffic on roads and other matters related to traffic safety on roads;

- control over national border crossing, movements and staying within border areas;

- residence and movement of foreigners;

- determining and resolving border incidents and other violations of national borders;

- placing, controlling and maintaining the insignia that mark the border areas on land and on water;

- protection from fire and explosives;

- controlling the conditions related to manufacturing, sale, supply, possession and carrying arms, parts of arms and ammunition;

- manufacturing, sale, storage, shipment and protection from explosive and other dangerous substances and storage and protection from flammable liquids and gases;

- control over the registration of residence and dwellings of citizens;

- providing assistance in eliminating consequences caused by natural disasters and epidemics that could threaten the life and health of citizens or their property;

- research and development from the field of its competence;

  • other matters stipulated by the law.

AMENDING THE INTERNAL AFFAIRS LAW

Article 1

The following Article 18-a shall be added to the Article 18 of the Internal Affairs Law (Official Journal of the Republic of Macedonia No. 19/95):

'Article 18-a

The Government of the Republic of Macedonia shall submit its opinion on the report referred to in Article 18, Paragraph 2 of this Law within 30 days from the day of the receiving the report by the Commission.'

This Law shall enter into force on the eighth day following the date of its publication in the Official Journal of the Republic of Macedonia.

In accordance with Article 75, Paragraph 1 and 2 from the Constitution of the Republic of Macedonia, the President of the Republic of Macedonia and the President of the Parliament of the Republic of Macedonia issue this

Article 78

This Law shall enter into force on the eighth day following the date of its publication in the Official Journal of the Republic of Macedonia.

 DECREE ON PROCLAIMING THE LAW ON INTERNAL AFFAIRS

ZAKON ZA VNATRE[NI RABOTI

I. OP[TI ODREDBI

^len 1

Vnatre{ni raboti vo smisla na ovoj zakon se raboti koi se odnesuvaat na:

- za{tita na `ivotot, li~nata sigurnost i imotot na gra|anite;

- spre~uvawe na vr{ewe na krivi~ni dela, otkrivawe i fa}awe na storiteli na krivi~ni dela i nivno predavawe na nadle`ni organi;

- za{tita na slobodite i pravata na ~ovekot i gra|aninot zagarantirani so Ustavot;

- spre~uvawe na nasilno urivawe na demokratskite institucii utvrdeni so Ustavot na Republika Makedonija;

- odr`uvawe na javniot red i mir;

- spre~uvawe na razgoruvawe na nacionalna, rasna ili verska omraza ili netrpelivost;

- obezbeduvawe na opredeleni li~nosti i objekti;

- regulirawe i kontrola na soobra}ajot na pati{tata i drugi raboti svrzani so bezbednosta na soobra}ajot na pati{tata;

- kontrola na preminuvawe na dr`avnata granica, dvi`ewe i prestoj vo grani~en pojas;

- prestoj i dvi`ewe na stranci;

- utvrduvawe i re{avawe na grani~nite incidenti i drugi povredi na dr`avnata granica;

- postavuvawe, kontrola i odr`uvawe na oznakite so koi se obele`uva grani~niot pojas na kopno i voda;

- za{tita od po`ari i eksplozii;

- kontrola na uslovite vo vrska so proizvodstvo, promet, nabavuvawe, poseduvawe i nosewe na oru`je, delovi za municija i municija;

- proizvodstvo, promet, skladirawe, prevoz i za{tita od eksplozivni i drugi opasni materii i skladirawe i za{tita od zapalivi te~nosti i gasovi;

- kontrola na prijavuvawe i odjavuvawe na `iveali{teto i prestojuvali{teto na gra|anite;

- uka`uvawe na pomo{ pri otstranuvawe na posledicite predizvikani od prirodni nepogodbi i epidemii koi mo`at da gi zagrozat `ivotot i zdravjeto na gra|anite i imotot;

- istra`uvawe i razvoj vo oblastite na negova nadle`nost i

- drugi raboti utvrdeni so zakon.
